1. About these terms
These Website Terms of Use (“Website Terms”) govern your access to and use of the website at kirak.io and its subdomains, together with all content on it — including our marketing pages, documentation, and blog (the “Website”).
The Website is operated by Sizmic Limited (“Sizmic”, “we”, “us”), a company registered in England and Wales, company number 15403344, registered office 78 James Smith Court, Dartford, England, DA1 5XL.
What these terms do not cover:
- Kirak Studio. If you create a Kirak Studio account, your use of that service is governed by the Terms of Service at kirak.io/legal/terms, not by these Website Terms.
- The open-source Kirak runtime. Your use of the runtime software is governed by the Apache License 2.0. These Website Terms cover only the Website and its content, including the documentation as published on the Website.
2. Acceptance and changes
By accessing or using the Website, you agree to these Website Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Website.
We may change the Website and these Website Terms at any time. Changes take effect when posted. Your continued use of the Website after a change means you accept the updated terms.
3. Permitted use
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Website and its content for your own personal or internal business information purposes.
4. Restrictions
You must not:
- copy, reproduce, republish, mirror, frame, sell, or redistribute any part of the Website or its content, except for brief quotations with attribution and a link;
- scrape, crawl, or harvest the Website or its content beyond what
robots.txtpermits, or use any automated system to access it in a way that sends more requests than a human could reasonably produce; - use the Website or its content to train, fine-tune, or evaluate any machine-learning model or dataset without our prior written permission;
- remove, obscure, or alter any copyright, trademark, or other proprietary notice;
- reverse engineer or attempt to extract the source code of the Website, except to the extent this restriction is prohibited by law;
- probe, scan, or test the vulnerability of the Website, or breach its security or authentication measures, except as expressly permitted by our Security Policy;
- interfere with or disrupt the Website or the servers or networks that host it;
- misuse any form, waitlist, or interactive feature, including by submitting false information or another person’s data without their consent; or
- use the Website for any unlawful purpose or in breach of these Website Terms.
5. Intellectual property
The Website and all of its content — including text, documentation, graphics, layout, design, and code — are owned by or licensed to Sizmic and are protected by intellectual property laws. Except for the limited licence in Section 3, no rights are granted to you.
“Kirak”, “Kirak Studio”, “Sizmic”, and the Kirak logo are trademarks of Sizmic Limited. Use of them is governed by our Trademark & Brand Policy.
If you send us feedback or suggestions about the Website or our products, you grant us a perpetual, irrevocable, royalty-free licence to use them without restriction or obligation to you.
6. Documentation
The documentation on the Website is provided for general information only. It may be incomplete, out of date, or inaccurate, and it may change without notice. It is not a warranty, a specification, or a contractual commitment. The authoritative terms for Kirak Studio are the Terms of Service; the authoritative licence for the runtime is the Apache License 2.0.
7. Submissions
Anything you submit through the Website (for example, a waitlist sign-up or a contact message) must not be confidential and must not infringe anyone’s rights. You grant us a licence to use what you submit for the purpose for which you submitted it (for example, to contact you about the waitlist). You are responsible for the content of your submissions.
8. Third-party links and services
The Website links to third-party websites and services, including code repositories and third-party AI assistants (“ask about Kirak on…”). We do not control and are not responsible for them. Following those links is at your own risk and subject to the third party’s own terms.
9. Disclaimers
The Website and its content are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of accuracy, completeness, merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be available, uninterrupted, secure, or free of errors or harmful components. To the extent any warranty cannot be excluded by law, it is limited to the minimum permitted.
10. Limitation of liability
The Website is provided free of charge, and you use it at your own risk. To the fullest extent permitted by law, we exclude all liability to you arising out of or in connection with your use of, or inability to use, the Website and its content — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — including any indirect or consequential loss and any loss of profits, revenue, data, business, or goodwill.
Nothing in these Website Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under the law of England and Wales.
11. Indemnity
You will indemnify us against any claim, loss, or cost arising out of your breach of these Website Terms or your misuse of the Website.
12. General
Governing law. These Website Terms and any dispute relating to the Website are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
Entire agreement. These Website Terms, the Privacy Policy, and the Cookie Policy are the entire agreement between you and us about your use of the Website.
Severability and waiver. If any provision is unenforceable, it is modified to the minimum extent necessary and the rest remains in effect. A failure to enforce a provision is not a waiver.
Assignment. You may not assign these Website Terms. We may assign them to an affiliate or successor.
Third-party rights. A person who is not a party has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce these Website Terms.
